Dan's Dog Wash is operated by DANIEL'S DOG WASH PTY LTD ACN 673 608 350 as trustee for Daniel's Dog Wash Unit Trust ABN 42 698 524 989 ("Dan's Dog Wash", "we", "us" or "our"). These Terms and Conditions apply to the use of the Dan's Dog Wash self-service dog wash facility, our website at dansdogwash.com.au, prepaid wash cards, promotions and related services.
By purchasing a wash, using the facility, purchasing or redeeming a prepaid card, or otherwise using our services, you agree to these Terms and Conditions.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth), or any other applicable law.
Our services are supplied subject to statutory consumer guarantees, including that services will be supplied with due care and skill and, where applicable, will be reasonably fit for their disclosed purpose.
Where we are legally required to provide a refund, replacement, compensation or other remedy, these Terms do not limit those rights.
Dan's Dog Wash is a self-service dog washing facility.
Unless we expressly state otherwise, no employee or attendant supervises your use of the washing equipment or your dog.
You are responsible for:
You must not leave your dog unattended while using the facility.
Using a self-service dog wash involves ordinary and reasonably foreseeable risks, including wet or slippery surfaces, water, moving animals, electrical equipment designed for use in a wet environment, dryers, hoses, tubs, steps and contact with other people or dogs.
You use the facility at your own risk to the extent permitted by law.
You are responsible for taking reasonable care for your own safety, the safety of your dog and the safety of any person accompanying you.
This clause does not exclude liability that Dan's Dog Wash cannot lawfully exclude, including liability arising from our failure to comply with applicable statutory obligations.
You are responsible for deciding whether your dog is physically and behaviourally suitable to use a self-service dog wash.
You must exercise particular care if your dog is elderly, very young, anxious, aggressive, injured, unwell, recovering from surgery, has a known medical condition, has sensitive skin or has previously reacted adversely to shampoos, conditioners, dryers or bathing.
If you are uncertain whether washing or drying is appropriate for your dog, you should obtain advice from a veterinarian before using the facility.
Dan's Dog Wash does not provide veterinary, animal-health or professional grooming advice.
Your dog must remain under effective control at all times.
You must comply with all applicable South Australian laws concerning ownership and control of dogs and with any lawful control, restraint or muzzle requirements applying to your dog.
Do not bring a dog into or continue using the facility if the dog is behaving aggressively or creates an unreasonable risk to another person or animal.
You are responsible for loss, damage or injury caused by your dog to the extent that it results from your failure to exercise reasonable control over the dog or comply with applicable law.
Children must be actively supervised by a responsible adult at all times.

You must not misuse, modify, dismantle, obstruct or interfere with any equipment.

Drying equipment must be used carefully and in accordance with the displayed instructions.
Do not direct concentrated airflow into a dog's eyes, ears, nose or other sensitive areas.
You are responsible for adjusting your use of the dryer according to your dog's size, coat, temperament and tolerance.
Stop using the dryer if your dog shows signs of distress.
Shampoo, conditioner or other products supplied at the facility are intended for ordinary dog-washing use.
Individual dogs can have allergies, sensitivities or reactions that may not be reasonably foreseeable.
If your dog has a known allergy or sensitivity, you are responsible for determining whether a product is suitable before use.
Nothing in this clause excludes any liability we may have where a product or service supplied by us fails to comply with the Australian Consumer Law.
Dog washing necessarily creates wet surfaces.
Customers should exercise reasonable care when entering, using and leaving the facility, including wearing appropriate footwear and supervising dogs and children.
Where you become aware of a spill, obstruction, damaged surface or other hazard that presents an unusual risk, please avoid the affected area and notify us as soon as reasonably practicable.
You are responsible for phones, wallets, keys, bags, clothing, vehicles and other personal property brought onto or left near the premises.
To the extent permitted by law, Dan's Dog Wash is not responsible for loss, theft or damage to personal property caused by circumstances outside our reasonable control.
This does not exclude liability where loss or damage is caused by our negligence, breach of contract or breach of a statutory obligation that cannot lawfully be excluded.
Customers must use the premises and equipment only for their intended purpose.
You may be responsible for the reasonable cost of repairing damage caused by your intentional, reckless or negligent misuse of the facility or equipment.
You are not responsible for ordinary wear and tear, equipment failure or damage that you did not cause.
Customers must leave the wash bay in a reasonably clean condition for the next customer.
Dog faeces and other waste must be promptly removed and disposed of appropriately.
Do not place inappropriate objects, chemicals, oils, dyes, hazardous substances or non-approved cleaning agents into the tubs or drainage system.
The facility is ordinarily available 24 hours a day, 7 days a week.
"Open 24/7" does not mean that every machine or service is guaranteed to be continuously available.
Equipment may temporarily be unavailable because of maintenance, cleaning, faults, utilities interruption, safety concerns, vandalism, emergencies or circumstances outside our reasonable control.
Where a customer pays for a wash that cannot reasonably be supplied because of equipment failure, we will provide an appropriate remedy in accordance with the Australian Consumer Law.
Current prices are displayed at the facility and/or on our website.
You must pay the applicable price before using a paid service.
Prices may be changed for future purchases. A price change will not retrospectively reduce prepaid value already lawfully acquired by a customer.
Dan's Dog Wash may issue physical or electronic prepaid wash cards.
A prepaid card:
Purchased Dan's Dog Wash prepaid cards have no expiry date unless a different lawful condition is expressly stated on the card.
Where Australian gift-card legislation applies, Dan's Dog Wash will comply with the applicable minimum redemption period, expiry-disclosure and fee requirements.
Some promotional, donated, loyalty, discounted and other specified cards may be subject to lawful exemptions or additional promotional conditions that are disclosed when issued.
Treat a physical prepaid card like cash.
Dan's Dog Wash is not required to replace a lost or stolen card where we cannot reasonably establish the card number, ownership or remaining balance.
Where we are reasonably able to identify and verify a card, we may choose to cancel and reissue it.
Any permitted replacement or reissue fee will only be charged where lawful and disclosed.
We do not ordinarily provide refunds simply because a customer changes their mind.
This does not affect a customer's rights where a refund or other remedy is required under the Australian Consumer Law.
From time to time Dan's Dog Wash may offer complimentary cards, promotional credit, loyalty rewards, discounted services or other promotions.
Additional conditions may apply to an individual promotion. Any such conditions will be disclosed clearly in connection with that promotion.
Where the law permits different expiry or redemption rules for promotional or complimentary cards, those rules may apply.
Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful.
Subject to that qualification, Dan's Dog Wash is not responsible for loss, injury or damage to the extent that it is caused by:
Where loss or damage is partly caused by Dan's Dog Wash and partly caused by your acts or omissions, our liability will be determined in accordance with applicable law.
We do not exclude responsibility for loss caused by our negligence, breach of applicable consumer guarantees or any other liability that cannot lawfully be excluded.
To the extent permitted by law, you indemnify Dan's Dog Wash against a third-party claim, loss or reasonable expense to the extent that the claim results from:

We may reasonably refuse, suspend or terminate access to the facility where necessary to protect people, animals, property or equipment, including where a person:

We may update these Terms from time to time where reasonably necessary to reflect changes in our services, equipment, operating procedures or applicable law.
Updated terms apply prospectively from the effective date shown on the website.
Changes will not retrospectively remove accrued prepaid value or statutory rights.

These Terms are governed by the laws of South Australia, Australia, and applicable Commonwealth laws.
Subject to any mandatory rights available to you under applicable law, disputes relating to these Terms are subject to the jurisdiction of the courts and tribunals competent to hear the dispute.
If any provision of these Terms is invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary where legally possible.
If it cannot be read down, it will be severed without affecting the remaining provisions.
